前言
飞蚕(www.feican.net,以下简称“本平台”)作为以“链接靠谱企业”为核心理念的企业服务导航平台,深知知识产权与合法权益保护对于构建可信商业环境的重要性。本平台严格遵守《中华人民共和国民法典》、《信息网络传播权保护条例》等相关法律法规,致力于尊重和保护权利人(包括但不限于著作权人、商标权人、名誉权人等)的合法权利。
鉴于本平台以信息展示与聚合方式,为用户提供经筛选的企业信息服务,为有效保护权利人合法权益,明确本平台处理侵权投诉的规则与流程,特制定本声明。
一、 处理原则
本平台遵循“通知-删除”与“反通知-恢复”的法定原则处理侵权投诉。在收到符合法定要求的侵权通知后,本平台将依法对涉嫌侵权的内容或链接进行初步审查并采取必要措施;在收到符合法定要求的反通知后,本平台将依法恢复被移除的内容或链接。
二、 权利通知(投诉流程)
任何个人或组织(以下简称“权利人”)如认为本平台展示、链接的第三方企业信息侵犯了其合法权益,有权向本平台提交书面权利通知,要求移除相关侵权信息或断开链接。
(一) 通知要件
一份合格的权利通知必须包含以下全部内容,并采用书面形式(含电子数据文件):
1. 权利人信息:权利人的姓名(名称)、联系方式(地址、电话、电子邮箱)。
2. 权属证明:清晰、完整的权属证明文件扫描件,例如:
◦ 涉及著作权的,可提供作品登记证书、创作手稿、首次发表证明等。
◦ 涉及商标权的,可提供商标注册证。
◦ 涉及名誉权、商誉权的,可提供相应的身份或资质证明及侵权事实的初步证据。
3. 侵权内容明确指认:
◦ 被控侵权信息在本平台上的确切名称和完整网址(URL)。
◦ 足以准确定位侵权内容的具体描述(例如,指出企业简介中哪段文字、哪张图片构成侵权)。
4. 侵权陈述:陈述您认为相关内容构成侵权的具体理由和法律依据。
5. 真实性保证与承诺:通知中必须包含以下声明:
> “本人在此保证,我是所投诉内容的合法权利人,或已获授权代为行使上述权利。本人确认,本通知中所述信息真实、准确、完整。本人理解,如本通知内容不实,本人将承担由此引发的一切法律责任(包括但不限于赔偿本平台及相关方因此遭受的损失)。”
6. 签字/盖章:权利人为个人的,需亲笔签名;为法人或其他组织的,需加盖公章。
(二) 通知提交
请将上述材料的电子版(建议整合为PDF格式)发送至本平台指定投诉邮箱:legal@feican.net。
邮件主题请注明:【权利通知】- 权利人名称 – 涉嫌侵权企业/内容简称。
三、 对权利通知的处理
本平台在收到符合上述全部要件的权利通知后,将启动处理流程:
1. 形式审核:对通知的完整性与形式要件进行审核。
2. 初步判断与转送:本平台将对通知进行初步审查,并及时将权利通知转送给被投诉的第三方(即相关企业信息提供方)。
3. 采取必要措施:如初步判断涉嫌侵权,或无法联系到被投诉方,本平台将根据情况采取包括但不限于屏蔽、断开链接、删除涉嫌侵权信息等临时性措施。
4. 处理告知:本平台将在采取必要措施后,通过邮件或其他可行方式告知投诉人处理情况。
四、 反通知(申诉流程)
如相关企业(即被投诉方)认为本平台采取的措施错误地移除了其不侵权的内容,可以向本平台提交书面反通知,要求恢复被移除的内容或链接。
(一) 反通知要件
一份合格的反通知必须包含以下全部内容:
1. 提交方信息:提交方的姓名(名称)、联系方式(地址、电话、电子邮箱)。
2. 被移除内容信息:被移除内容的完整名称及其在原页面的完整网址(URL)。
3. 不侵权声明与初步证据:
◦ 陈述被移除内容不构成侵权的具体理由。
◦ 提供相应的初步证据(如使用授权证明、作品合法来源证明、不构成名誉侵权的证据等)。
4. 真实性保证与承诺:反通知中必须包含以下声明:
> “本人在此保证,所提交的反通知内容真实、准确、完整。本人理解,如反通知内容不实,本人将承担由此引发的一切法律责任。”
5. 签字/盖章:提交方为个人的,需亲笔签名;为法人或其他组织的,需加盖公章。
(二) 反通知提交与处理
请将符合上述要件的反通知材料发送至:975938780l@qq.com。
邮件主题请注明:【反通知】- 提交方名称 – 涉及投诉单号(如有)。
本平台在收到合格的反通知后,将依法转送给原投诉人,并可根据情况在法定期限结束后恢复被移除的内容或链接。本平台对该恢复行为依法不承担法律责任。
五、 重要提示
1. 信息真实责任:通知人或反通知人应对其提交文件的真实性、合法性承担全部法律责任。如因提交虚假材料或恶意投诉/申诉给本平台或任何第三方造成损失,提交方应承担全部赔偿责任。
2. 平台立场中立:本平台作为信息展示服务平台,在侵权争议中保持中立。本声明所述流程系为履行法定义务而设立,本平台对通知与反通知的实质内容不做最终判断,相关争议应由权利人与涉嫌侵权方自行解决或通过司法、行政途径处理。
3. 免责:因权利人未按本声明要求提交合格通知,或提交错误、虚假通知而导致其权益受损或措施延误的,由权利人自行承担责任。因被投诉方未及时提交合格反通知而导致其内容被持续移除的,由被投诉方自行承担责任。
六、 声明修改
本平台有权在必要时修订本声明,修订后的声明将在本页面公布。如您继续使用本平台服务,即视为同意接受更新后的声明约束。

Feican Platform Rights Protection Statement

Preamble
Feican (www.feican.net, hereinafter referred to as “the Platform”), an enterprise services navigation platform with the core philosophy of “Linking Reliable Enterprises,” recognizes the paramount importance of intellectual property rights and the protection of legitimate interests in building a trustworthy business environment. The Platform strictly adheres to relevant laws and regulations of the People’s Republic of China, including the Civil Code and the Regulations on the Protection of the Right to Network Dissemination of Information, and is committed to respecting and protecting the lawful rights of right holders (including but not limited to copyright holders, trademark holders, and those with rights to reputation).
Given that the Platform provides users with screened enterprise information services through information display and aggregation, this Statement is hereby formulated to effectively protect the lawful rights and interests of right holders and to clarify the rules and procedures for handling infringement complaints.
1. Handling Principles
The Platform handles infringement complaints in accordance with the statutory principles of “Notice-and-Taktown” and “Counter-Notice-and-Restoration.” Upon receiving a qualified infringement notice that meets statutory requirements, the Platform will conduct a preliminary review and take necessary measures regarding the allegedly infringing content or links in accordance with the law. Upon receiving a qualified counter-notice, the Platform will restore the removed content or links in accordance with the law.
2. Notice of Claimed Infringement (Complaint Process)
Any individual or organization (hereinafter referred to as the “Complainant”) who believes that third-party enterprise information displayed or linked by the Platform infringes upon their lawful rights and interests has the right to submit a written Notice of Claimed Infringement to the Platform, requesting the removal of the relevant infringing information or the disconnection of links.
(1) Requirements for a Notice
A qualified Notice of Claimed Infringement must include all of the following contents and be submitted in written form (including electronic data files):
1. Complainant Information: The name and contact information (address, telephone number, email) of the Complainant.
2. Proof of Rights: Clear and complete scanned copies of documents proving ownership of the rights, for example:
◦ For copyright: Copyright registration certificate, manuscript, proof of first publication, etc.
◦ For trademark rights: Trademark registration certificate.
◦ For rights of reputation or goodwill: Corresponding proof of identity or qualification and preliminary evidence of the infringing facts.
3. Clear Identification of Infringing Content:
◦ The exact name and complete URL of the allegedly infringing information on the Platform.
◦ A specific description sufficient to accurately locate the infringing content (e.g., specifying which text or image in an enterprise profile constitutes infringement).
4. Statement of Infringement: A statement detailing the specific reasons and legal basis for believing the content constitutes infringement.
5. Declaration of Good Faith and Undertaking: The Notice must contain the following declaration:
> “I hereby guarantee that I am the lawful right holder of the content being complained about, or am authorized to act on behalf of the right holder. I confirm that the information in this Notice is true, accurate, and complete. I understand that I will bear all legal liabilities arising therefrom (including but not limited to compensating the Platform and related parties for any losses suffered as a result) if the content of this Notice is inaccurate.”
6. Signature/Seal: The Notice must be signed by the individual Complainant or sealed if the Complainant is a legal entity or other organization.
(2) Submission of Notice
Please send the electronic version of the above materials (recommended in PDF format) to the Platform’s designated complaint email: legal@feican.net.
Please use the following subject line: 【Notice of Claimed Infringement】- Complainant Name – Brief Name of Allegedly Infringing Enterprise/Content.
3. Processing of Notices
Upon receiving a Notice of Claimed Infringement that meets all the above requirements, the Platform will initiate the processing procedure:
1. Formal Review: The completeness and formal requirements of the Notice will be reviewed.
2. Preliminary Assessment and Forwarding: The Platform will conduct a preliminary review of the Notice and will promptly forward it to the third party in question (i.e., the relevant enterprise that provided the information).
3. Taking Necessary Measures: If a preliminary assessment indicates potential infringement, or if the third party cannot be contacted, the Platform may take interim measures including but not limited to blocking, disconnecting links, or removing the allegedly infringing information.
4. Notification of Outcome: The Platform will notify the Complainant of the handling result via email or other feasible means after taking necessary measures.
4. Counter-Notice (Appeal Process)
If the relevant enterprise (i.e., the party notified of the complaint) believes that the measures taken by the Platform have wrongly removed its non-infringing content, it may submit a written Counter-Notice to the Platform, requesting the restoration of the removed content or links.
(1) Requirements for a Counter-Notice
A qualified Counter-Notice must include all of the following contents:
1. Submitter Information: The name and contact information (address, telephone number, email) of the submitter.
2. Information on Removed Content: The full name of the removed content and its complete original URL on the Platform.
3. Declaration of Non-Infringement and Preliminary Evidence:
◦ A statement detailing the specific reasons why the removed content does not constitute infringement.
◦ Submission of corresponding preliminary evidence (e.g., proof of usage authorization, proof of legitimate source of the work, evidence refuting defamation, etc.).
4. Declaration of Good Faith and Undertaking: The Counter-Notice must contain the following declaration:
> “I hereby guarantee that the content of this Counter-Notice is true, accurate, and complete. I understand that I will bear all legal liabilities arising therefrom if the content of this Counter-Notice is inaccurate.”
5. Signature/Seal: The Counter-Notice must be signed by the individual submitter or sealed if the submitter is a legal entity or other organization.
(2) Submission and Processing of Counter-Notice
Please send a qualified Counter-Notice with the above materials to: 975938780@qq.com
Please use the following subject line: 【Counter-Notice】- Submitter Name – Related Case Number (if any).
Upon receiving a qualified Counter-Notice, the Platform will forward it to the original Complainant in accordance with the law and may restore the removed content or links after the expiration of the statutory period. The Platform shall not bear legal liability for such restoration in accordance with the law.
5. Important Notes
1. Liability for Information Accuracy: The notifier or counter-notifier shall bear full legal responsibility for the authenticity and legality of the documents they submit. If the submission of false materials or malicious complaints/appeals causes losses to the Platform or any third party, the submitter shall bear full liability for compensation.
2. Platform Neutrality: The Platform, as an information display service provider, remains neutral in infringement disputes. The procedures described in this Statement are established to fulfill statutory obligations. The Platform does not make final judgments on the substantive content of Notices or Counter-Notices. Relevant disputes should be resolved by the parties involved or through judicial or administrative channels.
3. Disclaimer: Right holders shall bear responsibility for any impairment of their rights or delays in measures resulting from failure to submit a qualified Notice as required by this Statement or from submitting an erroneous or false Notice. The party subject to the complaint shall bear responsibility for the continued removal of its content due to failure to submit a qualified Counter-Notice in a timely manner.
6. Amendments to this Statement
The Platform reserves the right to amend this Statement as necessary. The amended Statement will be published on this page. Your continued use of the Platform’s services constitutes your acceptance of the updated Statement.
